Terms of Service

Review draft covering managed setup, customer responsibilities, operational records, and access to My Temp Shield.

The service and these terms

My Temp Shield provides temperature monitoring, operational alerts, manual records, and related managed equipment and support services for restaurant businesses. These draft terms describe access to our website and application. The legal entity operating My Temp Shield must be identified before these terms are finalized.

If your organization has a signed service agreement or order, that agreement governs the purchased services, price, term, equipment arrangements, and specific service commitments. These website terms do not expand the features or support commitments in that agreement. Any conflict between these terms and the signed agreement must be resolved in favor of the signed agreement, subject to applicable law.

Authorized business use

Use the service only for an organization that has authorized your access and only within your assigned stores and role. Keep your account details accurate, protect passwords and offline PINs, and use your own identity when recording checks or responding to alerts. Do not share an account to avoid named attribution.

Customer administrators are responsible for keeping staff access and notification contacts current, including removing access when a person leaves or changes responsibilities. Tell our team promptly if you suspect unauthorized access. A person accepting an agreement on behalf of an organization must have authority to do so.

Managed setup and customer responsibilities

Our team manages store setup, station configuration, supported thresholds, equipment assignment, and installation. Customers should request configuration changes through our team and provide accurate information about the site. Equipment installation, repair, replacement, and access to premises are governed by the applicable service agreement.

The customer is responsible for monitoring its operations, responding to alerts, checking affected equipment and food, recording its actions, and following its food-safety procedures. Visibility of an alert to My Temp Shield staff does not transfer that responsibility to us. Do not assume our team has investigated or resolved an incident unless we have expressly confirmed a particular support action.

Readings, alerts, and operational limits

A reading describes a measurement at a particular time and place. It does not establish that every product in a station is safe. Sensors, power, connectivity, third-party delivery services, and configured recipients can affect monitoring and notification availability. Check the reading time, source, connectivity, and any unavailable or pending status.

An acknowledgement, manual entry, or recorded corrective action is a record of the person's response. It does not by itself establish that equipment or food has recovered. During an outage or missing-data condition, use your organization's fallback checks and procedures. The service does not provide emergency response, regulatory certification, or a guarantee against spoilage, illness, or loss.

Notifications and contact information

Authorized customer users configure supported notification channels and recipients. Provide contact details only for people authorized to receive the relevant operational information and obtain any permissions required to contact them. Keep recipients and routing rules current; a departed employee's number is not an effective response arrangement.

Delivery status may indicate that a request was queued or accepted by a provider. It does not always establish that a person received, read, or acted on it. Mobile carrier charges may apply. Changing notification recipients or disabling a channel does not remove the customer's responsibility to monitor its operations.

Customer records and permitted processing

Your organization retains its rights in the operational information it supplies. You authorize My Temp Shield to process that information to provide, secure, support, and maintain the service, produce authorized records and exports, and meet applicable obligations. Our Privacy Policy explains the handling of personal information associated with these activities.

Record checks accurately. Do not impersonate another person, fabricate readings, or alter evidence to conceal an incident. Corrections should preserve the original record and the identity and reason for the correction where the workflow supports this. Access removal does not necessarily erase a person's attribution in historical business records.

Acceptable use and service protection

Do not access another customer's information, bypass authorization, tamper with managed equipment or security controls, upload malicious material, or interfere with service availability. Do not use the service to store unrelated sensitive personal information in free-text notes. Report suspected vulnerabilities privately to our team.

We may restrict access when necessary to address unauthorized use, a security issue, or a legal requirement. Any suspension, notice, restoration, or termination process remains subject to the signed service agreement and applicable law. Restrictions on an account do not authorize the destruction of its required operational records.

Availability, changes, and third-party services

Available features depend on the customer's service and the approved equipment and deployment. Maintenance, outages, device failures, and third-party services can interrupt access or delay data. The signed agreement defines any uptime, response-time, warranty, or replacement commitment; marketing descriptions do not create an additional service-level guarantee.

We may maintain and improve the application. Material changes affecting contracted services or these terms should follow the notice and change procedures required by the agreement and applicable law. Linked third-party websites and operator tools have their own terms and privacy practices.

Fees, ending service, and legal provisions

Fees, billing, renewal, cancellation, refunds, ownership or return of equipment, and access to records after termination are governed by the signed service agreement. Customers should arrange any required record exports before their agreed access period ends. No specific retention duration is promised by this draft independently of the purchased service and applicable requirements.

Review item: counsel must supply or approve the operator's legal identity, governing law, dispute process, warranties, liability provisions, and any required jurisdiction-specific terms. This draft does not introduce an arbitration requirement, a liability cap, or a waiver of non-waivable rights. The page's review date is not an effective date for a final agreement.

Review item: the business must supply a working legal and privacy contact before these drafts are approved. Do not send passwords, offline PINs, or identity documents through a walkthrough request.
